Nigeria: President Buhari and his Vice dragged to court over assets declaration.

Nigeria’s President Muhammadu Buhari and his Vice, Yemi Osinbajo both have a fresh case of assets declaration filled against them by Anti-corruption agency group, Socio-Economic Rights and Accountability Project (SERAP) at the Court of Appeal.

 

The group is compelling the Code of Conduct Bureau (CCB) with an order of mandamus to make public the contents of the assets declaration forms filed by President Buhari, and VP Osinbajo, including that of the 36 state governors and their deputies. SERAP had its initial suit thrown out at The Federal High Court and has now decided to appeal its case. In a statement by the Deputy Director of SERAP, Kolawole Oludare, Justice Hassan of The Federal High Court misinterpreted the law and didn’t consider that the Freedom of Information Act was enacted by the country’s National Assembly in 2011 to give public access to public documents. It accused the learned trial judge of erring in law by holding that SERAP’s application lacks merit and is accordingly dismissed.

 

SERAP is holding unto the fact that the Freedom of Information Act is a legislation of general nature in relation to public access to asset declaration forms of public officers, and if the CCB fail to provide the information it requests for, that will further constitute a violation of their right to freedom of information guaranteed by Article 9 of the African Charter on Human and Peoples’ Rights.
